Terms and Conditions

James Anthony Weddings – Wedding Photography Services

1. Agreement

By paying the booking fee, the Client confirms acceptance of these Terms and Conditions. Any amendments must be agreed in writing by both parties.

This agreement is governed by the laws of England and Wales and subject to the exclusive jurisdiction of its courts.


2. Booking Fee and Payment

A non-refundable booking fee of 30% of the total agreed package price is required to secure the wedding date. The date is not reserved until this payment has been received.

The remaining balance must be paid no later than 8 weeks before the wedding date.

Failure to pay the balance by the due date may result in cancellation of services and forfeiture of monies paid. James Anthony Weddings reserves the right to reallocate the date if payment is not received.

If the wedding is postponed and James Anthony Weddings is available on the new date, payments may be transferred. If unavailable, the booking fee will be retained.

Travel expenses are charged at £1 per mile for return journeys unless otherwise agreed. Accommodation and transport costs for weddings requiring extended travel will be agreed in advance.


3. Substitution of Photographer

James Anthony Weddings is led by James Nader. In the unlikely event that James Nader is unable to attend due to serious illness, injury, death, or other unforeseen circumstances beyond reasonable control, James Anthony Weddings reserves the right to appoint a suitably qualified and experienced replacement photographer.

Any substitute photographer will be of comparable professional standard and style.

If a suitable replacement cannot be secured, liability shall be limited to a full refund of all monies paid.

This clause protects continuity without compromising quality.


4. Force Majeure

James Anthony Weddings shall not be liable for failure to perform obligations under this contract where such failure is due to events beyond reasonable control. This includes, but is not limited to, acts of God, severe weather, government restrictions, war, terrorism, pandemics, illness, venue closure, or transport disruption.

In such circumstances, every reasonable effort will be made to reschedule services or provide a suitable alternative. If performance becomes impossible, liability will be limited to a refund of payments received.


5. Artistic Licence

James Anthony Weddings retains full artistic licence regarding style, composition, editing, and image selection.

The Photographer’s professional judgement on lighting, timing, location, and number of delivered images shall be final.

Certain venues may impose restrictions on equipment or positioning. James Anthony Weddings cannot be held responsible for limitations caused by venue rules or external factors.


6. Cancellation by Client

Cancellations must be made in writing.

More than 7 months before the wedding date. Booking fee retained.

Between 7 months and 3 months before the wedding date. 50% of total package payable.

Within 3 months of the wedding date. 75% of total package payable.

James Anthony Weddings strongly recommends appropriate wedding insurance.


7. Additional Coverage

Additional coverage hours may be requested at £250 per hour if arranged in advance.

If requested on the wedding day, additional hours are charged at £300 per hour and must be settled prior to delivery of final images.


8. Image Delivery

Edited digital images will be delivered via private online gallery within 6 to 8 weeks unless otherwise agreed.

All images will be professionally edited for exposure, colour balance, contrast, and consistency.

Raw files are not provided under any circumstances.

Additional retouching requests may incur further charges.


9. Copyright and Usage

All copyright remains with James Anthony Weddings under the Copyright, Designs and Patents Act 1988.

Clients are granted a personal licence for private use, including printing and sharing on social media with credit.

Images may not be sold, altered commercially, or submitted for publication without written consent.


10. Promotional Use

James Anthony Weddings may use selected images for portfolio, website, social media, editorial submission, and promotional purposes.

Clients requesting privacy must notify in writing prior to the wedding date.


11. Limitation of Liability

In the unlikely event of total loss of images due to circumstances beyond reasonable control, liability shall be limited to a refund of monies paid.

For partial loss, liability shall be proportionate to the number of images lost relative to the total delivered.

James Anthony Weddings shall not be liable for indirect or consequential losses.


12. Data Protection

Client data will be handled in accordance with UK GDPR and stored securely.

Personal information will not be shared with third parties without consent.

Clients may request access to or deletion of their personal data at any time.


13. Complaints

Any concerns must be raised in writing within 28 days of image delivery.

James Anthony Weddings will endeavour to resolve matters professionally and promptly.

4. Artistic Licence

James Anthony Weddings retains full artistic licence regarding style, composition, lighting, editing and final image selection.

The Photographer’s professional judgement in respect of poses, locations and number of images delivered shall be final.

Due to factors beyond reasonable control, including weather conditions, venue limitations or subject cooperation, it may not be possible to capture all requested images.


5. Requested Images and Missed Moments

While every reasonable effort will be made to capture significant moments and requested images, photography is an observational art form and no guarantee can be given that specific individuals, expressions or events will be captured.

Coverage is influenced by timing, lighting, guest cooperation, venue rules and unforeseen circumstances.

The Client accepts that the Photographer cannot be held liable for missed shots resulting from these factors.


6. Additional Coverage

Additional coverage may be requested at £250 per hour if arranged in advance.
